移民局更新H-1B拒绝受理条件,你是否也在其中?


前日,移民局宣布将从今年8月5日起,将拒绝受理没有填写申请人或受益人名称和办公地址的I-129表格。

I-129表为非移民工作者申请表,用于H-1B等非移民工作签证的申请。

美国国土安全部门要求每份表格都按照表格说明提交,并允许移民局拒绝任何未按照规定提交的申请。

目前,移民局拒绝受理I-129表的主要原因有:

  • 签名缺失

  • 未授权第三方签字

  • 申请费错误等

I-129表格第1部分中的主要办公地址不得是申请人或受益人律师的地址。错误的地址会导致I-129表格审理时间的延长,或直接导致拒绝。

在多数情况下,申请人或受益人的主要办公地址将决定H-1B受理中心的地址。有关在何处递交申请,可参见移民局官网的:Direct Filing Addresses for Form I-129, Petition for a Nonimmigrant Worker

因信息缺失而拒绝的I-129表格通常可以修改错误后重新提交。但在移民局收到足够数量的申请之后,重新提交的申请或将被拒绝。

H-1B批准后的注意事项

2019财年的H-1B批准率,从前一年的84.5%,下滑到了79.4%,为持续下滑的第三年。

在H-1B签证获得移民局批准之后,并不代表申请人从此高枕无忧了,同样还有一些事项需要申请人特别注意:

  • 去领馆面签时强烈建议,申请人需携带批准函原件。此外,在DMV申请或更新驾照时,H-1B签证持有者也需要携带批准函原件前往;

  • 境内转换身份的申请者的批准函内会含有一份I-94,在出入境时需携带该表格;

  • 在H-1B签证正式生效之前的Cap-gap期间,不建议出境。若申请人出境且返回美国的日期在九月底十月初之间,建议申请人取得H-1B签证之后再返回美国;

  • H-1B在10月1日生效之后,申请者必须为H-1B申请批准的雇主工作。同时,雇主在员工入职3天内填写I-9表格。
