市场营销岗位遇上地产公司雇主,看移民局此番质疑究竟是否合理


2020财年H-1B RFE审理结果正在陆续放出,近日,我所又收到了多则RFE后成功获批的案例。今天挑选其一与大家进行分享,希望能给有相似情况的申请人提供借鉴!

A公司为一家小型地产公司,今年4月我所为Y同学提交了市场营销类别的H-1B申请。地产公司的商业运作模式极具特殊性,比如房地产经纪人在公司员工比例中占绝大多数,而他们在公司中大多是以独立合同员工(Independent Contractor)的身份出现,因此一家地产公司是否需要非地产经纪员工,特别是市场营销类型的员工,经常会面临移民局的挑战。Y同学收到的RFE中,移民局就对其岗位的专业性提出了质疑,同时对公司办公地点是否真实存在也提出了疑问。
