近期，美国移民局发布的2019年前三季度数据中显示，几类需雇主赞助的非移民类签证的RFE概率和拒绝率仍在持续升高。从H-1B签证的数据来看，2019财年的前三季度总体批准率为83.9%。虽然与2018财年前三季度的批准率相当，但与2017财年同期相比下降近10％ 。

H-1B批准率降低的同时，RFE的概率相应升高。2019财年前三个季度的H-1B RFE率为39.6％，略高于2018财年同期的比率，但该比率几乎是2017财年同期的两倍。RFE后获得批准的概率比2017财年同期下降了11％以上，比2015财年下降了20％以上。
在如此的审核形式下，我所依旧保持着H-1B高批准率，陆续收到多则H-1B直接获批或在RFE后成功获批的好消息。成功故事已经和大家陆续做了分享，比如因职位专业性，或公司特殊商业模式遭到RFE但在回复后成功获批的案例。今天要分享给大家的是我们近期接触到的一种“另类”成功故事：H-1B获批，但境内转换身份（Change of Status）却被拒的情况。
I-129申请表中包含两大部分的申请，一是H-1B身份的申请，另一是境内转换身份的申请。对于第一次递交H-1B申请的申请人来说，律师都要为其勾选是否进行境内转换身份的选项。大多数申请人，为了能够实现从F-1到H-1B身份的自动转换，会选择在申请H-1B的同时，选择在境内转换身份。而今年，我们发现移民局对境内转换身份申请的部分，也就是对申请人过往合法身份维持的审查格外严格。这一严格审核具体体现在例如申请人是否使用了超过规定的CPT或OPT工作许可，或申请人在递交申请后出境的情况。于是，也就出现了申请人H-1B获批，但境内转换身份申请被拒的情况。
在这种情况下申请人必须在合理的时间段内出境，通过美国使领馆进行面签获得H-1B签证，再持有效签证等回到美国为雇主工作。
