从2018年春季以来,取消H-4签证持有者的工作许可证(EAD)的计划,一直在特朗普政府的监管议程当中。早在今年2月,该计划已被提交至美国管理和预算办公室(OMB)进行审查;但时至今日,OMB对此计划的推进工作仍无明确反馈。
近日,美国国土安全部(DHS)向华盛顿特区联邦巡回上诉法院提交,针对“拯救美国工作”(Save Jobs USA)案件的答复信件,其中表示“该计划的拟议法规最早可能于2020年春季公布”。

截至目前,I-140移民签证申请获批的H-1B签证持有人配偶,仍然可以根据现行规则,向USCIS递交EAD申请。现行部分细则,包括:
H-4工卡持有人最早可于其当前文件到期前六个月提交续签申请;
H-4工卡申请可以与H-1B申请人的延期申请一同提交,包括H-1B申请递延超过6年的情况;
其他类别签证持有人可在递交转换H-4签证身份申请时,同时递交H-4工卡申请。
