律师视角分析:职位专业性如何充分论证


职位专业性(Specialty Occupation)一直是近年来移民局审理H-1B申请时的重点考察内容。通常,移民局会参考美国劳工统计局提供的职业展望手册(OOH),来判断进行H-1B申请的职位是否满足职业专业性要求,但并不作为唯一标准来衡量,特别是美国劳工统计局也曾声明OOH不作为法律依据。距离新财年H-1B电子注册开放仅剩18天的时间,现阶段雇主与雇员需完成最后的沟通,确定申请的专业职位及工资标准。在今天的文章中,我们将与各位读者分享一则成功案例,来看申请时如何更好地呈现职位专业性。

职位专业性如何完全体现

成功案例:

客户H为数学专业的硕士研究生,毕业后从事Price Analyst工作。经过与客户H初步的电话沟通和基础评估审核,我们确定了适合其的几个Job Category作为备选。在签订律师委托书后,经过与雇主的进一步沟通,我们最终确认了客户H进行申请的职位名称以及薪资标准,同时我们也为雇主和客户H分析了申请中可能面临的挑战。

我们在移民局开放接受H-1B申请的第一天将材料寄到了移民局。同年9月末,我们收到移民局的补件通知,主要针对雇佣关系以及职位专业性(Specialty Occupation)这两点提出质疑。对于雇佣关系,我们在补件材料中论据充分地说明了申请人的职位及公司情况,并附上公司组织架构、薪资支付等大量及充分的支持材料。

针对职位专业性这一点,我们认为,移民官在审理材料时,并不只关注所申请的职位名称,会更多地通过具体的工作职责来判断该职位是否具有专业性。因此,我所律师与申请人再次详细地讨论并整理了客户H的工作职责,并附上工作样本来证明客户H的工作内容确实需要复杂的数学知识和数学技能,与其所学的专业密切相关。最终客户H的申请在经过RFE后顺利获得批准。

具体的工作职责比职位名称更能反映申请者的工作是否具备专业性。移民局在审理申请材料时,会更注重这一点。
