人在境外,H-1B持有人的工资要怎么算?


昨日的文章中我们提到,关于H-1B签证的两种不同激活方式,以及是否可以在已获批境外激活H-1B的情况下申请进行境内身份转换。而在现阶段疫情的影响之下,美国政府发布的一系列中美旅行限制,同样导致部分已经顺利完成身份转换的H-1B持有者,在先前返回中国后无法按时回到美国开始工作。对于这类外籍员工,其在境外的这段时间内,雇主是否需要照常支付薪水呢?

H-1B雇主和雇员的雇佣关系仅在员工身在美国境内时有效。对于身在美国境外的H-1B雇员,雇主无需支付其薪资;同时,员工也可受雇于其他非美国雇主。而当员工返回美国境内之后,员工只可为提供H-1B签证支持的雇主工作,雇主也需根据LCA上的现行工资标准向员工支付薪水。

H-1B现行薪资标准

在准备H-1B申请材料时,劳工情况申请(LCA)是第一步。而在申请LCA过程中,美国雇主必须证明其将会付给该外籍雇员的报酬不低于当地现行工资标准(Prevailing Wage)。现行工资标准主要会受到受益人的工作职称、教育背景、工作所在地区以及工作职责等因素的影响。

H-1B现行工资标准可在Foreign Labor Certification Data Center中查询到。申请人可在页面中选择想要查找的数据时间,想要查找的地区以及职业,查询到的结果会显示申请人所选择的区域、时间和职业的现行工资标准,而申请H-1B时的薪资至少要符合页面上显示的Level 1 Wage的标准。

若受益人目前的工资达不到其所在地区的现行工资标准,可以采取以下几种解决办法:

  • 和雇主针对薪资问题进行沟通,尽量满足最低薪资要求,需要注意该标准为10月1日起将执行的薪资;

  • 更换申请的职位名称,依照实际工作内容可以有不同的职位选择,而每个职位的现行工资标准都不相同,在调整受益人职位名称之前,最好先向专业律师咨询;

  • 若公司在其他地区有分公司,可以查询自己的工资是否满足其他地区的现行工资标准,如果满足可向公司申请去相应地区工作;

  • 若薪资与标准相差太大且上述办法均无法实行,申请人可按照时薪来计算薪资,并适当缩减工作时长,进行Part-time的H-1B申请,申请过程与Full-time的申请无异。
