员工入职前需接受大麻检测?纽约雇主这样做可能违法

今年的5月10日,纽约市通过了Intro 1445-A 法案,其主旨是禁止纽约市雇主要求求职者接受大麻中活性成分四氢大麻酚(THC)的检测。新法案预计在2020年5月10日生效,届时,除法案规定的例外情况,纽约市雇主均应遵守该法律规定。

 

背景信息

2014年,纽约州通过并颁布了《同情关怀法》(Compassionate Care Act),法案将医用大麻合法化。 2018年,针对休闲用大麻市场,纽约州长Andrew Cuomo和市长Blasio同时发布报告称, “受管制的休闲用大麻市场好处大于其潜在的负面影响” 。此后,纽约州长持续呼吁州立法机构力争在2019年6月立法会议结束前将纽约的休闲用大麻合法化。纽约市议会于2月份介绍了其拟定大麻相关法案,其中就包括Intro 1445-A,并就相关法案举行了听证会。

 

Intro 1445-A的重要信息

该法案修订了纽约市行政法典第8-107节,增加了一个新的细分:“就业;就业前药物检测政策。”这一新的细分规定,雇主,劳工组织,职业介绍所或代理人如果以求职者提交大麻或THC测试作为雇佣条件,将被视为非法歧视。

 

例外情况

Intro 1445-A还列出了一些例外情况,允许部分纽约市雇主要求求职者进行大麻和THC的就业前药物测试。具体来说,纽约市行政法典不适用于申请以下职位的个人:

  1. 根据纽约市建筑法规第3321条或劳动法第220-h条的要求,需要接受OSHA 10培训以在建筑工地上工作的任何职位;

  2. 任何需要商业驾驶执照的职位;

  3. 任何需要监督或照顾儿童,医疗病人或弱势人群的职位(根据社会服务法第488条第15款所界定)等九个分类。

雇主们应未雨绸缪
