8月12日，美国第二巡回上诉法院发布指令，允许美国国土安全部（DHS）在除佛蒙特州、康涅狄格州和纽约州以外的州内实施公共负担新政。7月29日，移民局和国务院曾相继发布公告，根据法庭颁布的禁制令，叫停疫情期间在全国范围内公共负担新政的实施。本次第二巡回上诉法院发布的指令，宣布仅在上述三个州内限制实行公共负担新政。
在佛蒙特州，康涅狄格州和纽约州内，DHS必须继续应用在2020年2月24日之前制定的公共负担政策。在实施公共负担新政的州提交的移民申请，则必须再次遵守新政的相应表格和文件要求。
