DOL Resumes Processing of Certain Labor Certification Applications

The Department of Labor's OFLC has resumed limited operations, and the FLAG system is now accepting select applications. Here's the latest update:

Applications Being Processed:

  • Prevailing wage determination requests for PERM applications.

  • PERM applications for EB-2/EB-3 applications

  • H-2A and H-2B temporary labor certifications

These filings are actively being processed, though delays are possible due to system backlog and increased demand.

Applications with Processing Still Pending:

  • LCAs for H-1B, H-1B1 and E-3 can be submitted now, but certification may be delayed until full operations resume. Employers can also access previously certified LCAs.

What This Means for Employers and Applicants:

  • PERM and prevailing wage filings can move forward, though processing may be slower than usual.

  • H-1B petitioners may file petitions now even if the LCA is still pending certification. This approach preserves the filing date and demonstrates that the petition was otherwise complete.

We are actively filing LCAs, prevailing wage requests, PERM applications, and other employment-based petitions for our clients. If you have questions or need guidance, please click here to contact us for guidance and personalized support.
