DOL Resumes Processing of Certain Labor Certification Applications

The Department of Labor's OFLC has resumed limited operations, and the FLAG system is now accepting select applications. Here's the latest update:
Applications Being Processed:
Prevailing wage determination requests for PERM applications.
PERM applications for EB-2/EB-3 applications
H-2A and H-2B temporary labor certifications
These filings are actively being processed, though delays are possible due to system backlog and increased demand.
Applications with Processing Still Pending:
LCAs for H-1B, H-1B1 and E-3 can be submitted now, but certification may be delayed until full operations resume. Employers can also access previously certified LCAs.
What This Means for Employers and Applicants:
PERM and prevailing wage filings can move forward, though processing may be slower than usual.
H-1B petitioners may file petitions now even if the LCA is still pending certification. This approach preserves the filing date and demonstrates that the petition was otherwise complete.
